Planning Board Meeting Minutes
(Regular Meeting)
Town of Brutus Municipal Building, 9021 North Seneca Street, Weedsport, NY 13166
Wednesday August 26, 2015 at 7:00pm
Planning Board Members Present: John Abraham (V), Joe Barwinczok (T), Don Bowden (T), Frank Gross (V), Dave Lipiska (T-Alt), Derek Ostrowski (V&T), Jim Scanlon (T) Nancy Sweet (V-Alt)
Absent: Brenda Suslik (V-Alt), and Norman Wightman (T-Alt), Lynette Murray- Planning Board Clerk

OPENING:
The meeting was called to order at 7:00pm by Chairman Ostrowski who also led the Pledge of Allegiance.
Chairman Ostrowski asked if there were any questions, additions or deletions to the minutes from the July 22, 2015 meeting. Member Barwinczok motioned to accept 7-22-15 as written. Member Gross seconded the motion. VOTE: 6 ayes; 0 nays. Carried.
KYLE, PETER: INFORMATIONAL: AGRICULTURAL SUBDIVISION and/or 2 LOT SUBDIVISION: BALL ROAD TAX MAP ID #88.06-1-2.311; Vacant Land; AR.
Mr. and Mrs. Kyle approached the board indicating that they had been sent to the Board by Assessor Kelly to determine what they needed to do to subdivide their property. Chairman Ostrowski shared with the Board the maps and email provided by Assessor Kelly. The Kyles indicated that this was an agricultural subdivision and referred to the Town of Brutus code that indicated that agricultural subdivisions were exempt from the subdivision process.
The Kyles indicated that they had done a similar subdivision last year and were unsure why they needed to come to the Planning Board this time.
Chairman Ostrowski and the Board indicated that they were unaware of the agricultural exception and were unsure exactly how to interpret this part of the code or what steps were to be done for an agricultural subdivision. Nor did the board know who had authority to authorize such a subdivision. Chairman Ostrowski indicated that if the Kyles wished to proceed with a "normal" subdivision process using the Planning Board's process then the Planning Board could help them. Otherwise, if they wished to pursue an "agricultural" subdivision, the Kyles would need to go back to Assessor Kelly to determine who had proper authority and how to proceed.
The Kyles indicated that they were planning an auction for the land in the coming weeks and wished to complete the subdivision process quickly therefore they would be going back to Assessor Kelly to determine the process for an agricultural subdivision.
Chairman Ostrowski indicated that he would contact Councilman Miller to get further direction on how to interpret the agricultural exception to the subdivision code.
The Kyles left the meeting at approximately 7:30.
BREESE, ALLAN: INFORMATIONAL: 2 LOT SUBDIVISION: 2356 STATE RT. 31 TAX MAP ID #82.00-1-9.11; Single Family Residence; AR; 25.9 ACRES
Mr. Breese approached the Board with maps of his property indicating a general area that he wished to subdivide approximately 5 acres from the main lot. He is in the process of selling the home on the property and the prospective buyers only want to buy 5 acres therefore he wishes to subdivide to create a lot that is approximately 5 acres around the residence. He indicated that he wouldn't know the exact size or layout until the lot was surveyed and he was leaving it up to the surveyor to make recommendation on the lot lines based on their professional opinion.
The members of the board indicated that there didn't appear to be any obstacles to this subdivision and that they could proceed with the process if Mr. Breese would like to move forward.
Mr. Breese indicated that he would like to proceed. He also asked if the process could be expedited by holding the public hearing at the next meeting.
Chairman Ostrowski indicated he had no objection to this if the rest of the board was OK with it but would need to verify with Clerk Murray that there was enough time to notify the public and any necessary neighbors. Somebody would be in contact with Mr. Breese to notify him if the public hearing was possible and Clerk Murray would be sending correspondence as to what Mr. Breese would need to for the next meeting. Chairman Ostrowski also suggested that Mr. Breese only spend money on 1 copy of the map until the board makes final approval.
Mr. Breese indicated that if the public hearing cannot be held next month then he would need to work with the buyers to possibly perform the subdivision after the sale of the property. The board indicated that this would be OK but would be the responsibility of Mr. Breese to which he agreed.
Member Barwinczok motioned to declare this a subdivision and that proceed with a public hearing next month if there are no time restrictions. Member Bowden seconded the motion. VOTE 6 ayes; 0 nays. Carried.
Mr. Breese left the meeting at approximately 7:45.
CORRESPONDENCE/OTHER ITEMS:
- Late Member Sullivan: Chairman Ostrowski indicated that he would be making a donation to Hospice in memory of Mr. Sullivan on behalf of the Planning Board if anyone still wished to proceed.
- Wayne County Training: Alternate Member Sweet reminded the Board that there would be upcoming subdivision training in Wayne County. Chairman Ostrowski indicated the Wayne County facility was very nice and they had a very good instructor and he encouraged attendance. He also indicated that members could be reimbursed for mileage to and from this training.
CLOSING:
At 8:15 pm, Member Barwinczok motioned to adjourn the meeting. Member Bowden seconded the motion. VOTE: 6 ayes; 0 nays. Carried.
