Town of Brutus Municipal Building, 9021 North Seneca Street, Weedsport, NY 13166

Wednesday April 27, 2016 at 7:00pm

 

Planning Board Members Present: John Abraham (V), Joe Barwinczok (T), Don Burdick (V-Alt),

Frank Gross (V), Dave Lipiska (T-Alt), Derek Ostrowski (V&T), Jim Scanlon (T)

Absent:   Don Bowden (T), Nancy Sweet (V)

 

Also Present: Lynette Murray— Planning Board Clerk

 

Meeting Attendants: Greg Rigby, Mike Long, Ron and Kay Rizzo

 

OPENING:

The meeting was called to order at 7:00pm by Chairman Abraham who also led the Pledge of Allegiance.

Chairman Abraham asked if there were any questions, additions or deletions to the minutes from the March 23, 2016 meeting. Member Gross motioned to accept *3-23-15 3/23/16 as written. Member Ostrowski seconded the motion. VOTE: 5 ayes; 0 nays. Carried. 

 

RIGBY, GREG- (OWNER of HIDDEN GREENS, LLC): PLAT MAP: INTERESTED IN SELLING LOTS AT HIDDEN GREENS: Tax Map #77.00-3-9, 77.00-3-10, 77.00-3-11, 77.00-3-18 and 77.00-2-45.112; approximately 19.6 +/- ACRES; AR District.

 

Mr. Rigby and Mr. Long approached the board and stated the three changes that are being proposing to the board.

First change: At the south end, merge the following five lots Tax Map #77.00-3-9, 77.00-3-10, 77.00-3-11, 77.00-3-18 and 77.00-2-45.112 and turn into one lot (one tax map) of less than 20 acres.

Member Ostrowski stated this may be considered a lot line adjustment and Planning Board avoids any lot line adjustments nor does Planning Board combine any lots. Member Ostrowski advised Mr. Rigby to check with Cayuga County Real-Property about combining the lots into a single tax bill. Planning Board is asking Mr. Rigby to include an easement for access to the currently unused hydrant. It was mentioned that the fire hydrant is not an active working one and should be covered up so that it is not mistaken to be operable. Mr. Rigby advised that original plans had public water and that there is an 8” to 12” water main going the length of the road. Should this ever become a part of the water district hydrants can be hooked up, flushed and working. All lots will have wells; Mr. Long and Mr. Rigby met with the Health Department regarding this and the Health Department was fine with this as far as they provided revised drawings and there were no specifics for the large parcel.

Second change: Eliminate the retention pond on lot #18. Leave it as a pond. Mr. Rigby advised the board the potential buyer plans to build a house on the property and did not for see the need of the retention pond.

Member Ostrowski is going to reach out to the Town Engineer Tom Piascik and ask if Mr. Rigby should extend the easement to the retention pond and whether or not the retention pond was still necessary.

Third change: Terminating the existing road (between the boundary of lot 8 and formerly lot 9) and leaving the existing unfinished road for access into the new proposed lot.
Member Ostrowski researched the original subdivision of the property and how the County has it recorded and the Road itself is a parcel and part of Hidden Greens LLC.

Member Ostrowski motioned this to be a Minor Subdivision of property located at Hidden Greens Road;

Subdividing the Road Tax Map # 77.00-3-99 (5.18 ACRES) from the boundaries of lot 8 (77.00-3-8) and lot 9 (77.00-3-9), across to the corner of lot 12 (77.00-3-12) and 78.00-1-38and have 60 foot easement up to the fire hydrant or up to the retention pond based on Town Engineer input.

Member Gross second the motion.

VOTE: 5 ayes; 0 nays. Carried. 

 

Member Ostrowski motioned to schedule a Public Hearing for the May 25, 2016 Planning Board Meeting. Member Gross second the motion.

VOTE: 5 ayes; 0 nays. Carried. 

 

 

7:30 Mr. Rigby and Mr. Long left meeting.

 

 

 

 

 

RIZZO, RON: INFORMATIONAL: 2-LOT SUBDIVISION: PROPERTY LOCATED, 2292 STATE ROUTE 31; TAX MAP #77.00-2-22.3; 33.69 ACRES; RESIDENTIAL & COMMERCIAL DISTRICT; FLOOD PLAIN (REPRESENTED by SALLY WALKER)

 

Mr. and Mrs. Rizzo had maps that were turned in by Sally Walker (Real Estate Agent and Sub-Division representative). Planning Board members reviewed the maps submitted and made several recommendations to the Rizzo’s.

The Board suggested the Rizzo’s to meet with Code Enforcement Officer Tim Ganey to discuss the particulars on whether or not to proceed with a third subdivision of the property. The property is commercially zoned should they consider this option would a buyer be able to build a house or business. Planning Board will re-visit this option at the May meeting.

 

7:50 Mr. and Mrs. Rizzo left the meeting.

 

CORRESPONDENCE/OTHER ITEMS:

 

  • Resignation of Norman Wightman (Town Alternate) and Johanna Donivan (Village Alternate).
  • Brief discussions on Solar Farm Developers targeting local farms.

 

 

CLOSING:

At 8:17 pm, Member Gross motioned to adjourn the meeting.  Member Barwinczok seconded the motion.  VOTE: 5 ayes; 0 nays.  Carried.
