OPENING:
The meeting was called to
order at 7:00pm by Chairman Abraham who also led the Pledge of Allegiance.
Chairman Abraham asked if
there were any questions, additions or deletions to the minutes from the April
27, 2016 meeting. Note: In order for a quorum Town Alternate Member Lipiski
will step in as an active member with voting rights. Member Ostrowski motioned to accept *4-27-15 4/27/16 as written. Member Scanlon seconded
the motion. VOTE: 4 ayes; 0 nays. Carried.
RIGBY, GREG- (OWNER of HIDDEN GREENS, LLC): PLAT MAP:
INTERESTED IN SELLING LOTS AT HIDDEN GREENS: Tax Map #77.00-3-9, 77.00-3-10,
77.00-3-11, 77.00-3-18 and 77.00-2-45.112; approximately 19.6 +/- ACRES; AR
District.
7:02 Chairman Abraham opened the Public Hearing.
Maps were distributed and Mr.
Rigby approached the board and restated that at the south end, he would like to
merge the following five lots Tax Map
#77.00-3-9, 77.00-3-10, 77.00-3-11, 77.00-3-18 and 77.00-2-45.112 and turn into
one lot (one tax map) of less than 20 acres. Eliminate the existing road (between the
boundary of lot 8 and formerly lot 9) and create a new road for access into the
new proposed lot with an alternate hammerhead turnaround. (Mr. Rigby stated he
had spoken to the Highway Super Intendant who suggested the hammerhead turn
around.)
Planning Board Members were
concerned about the non-working Fire hydrant and would like Mr. Rigby to reach
out to Code Enforcement Officer and/or the Fire Marshall and discuss how the
hydrant should be labelled as a non-working dry hydrant so that it would not be
assumed to be a working hydrant.
Regarding the
detention pond on lot #18 Town Engineer Tom Piascik communicated
via email “that the south detention pond may be eliminated if only one home is built and
saw no need for it as the increase in storm water runoff would be less compared
to the runoff from agricultural land uses.”
Town Engineer also mentioned at one time it
was discussed offering a limited access easement to a landlocked parcel owned
by Art Luke adjacent to said subdivision and allow access to land. Mr. Rigby researched the land locked piece of land
and found that that piece of land was landlocked long before the Hidden Greens
project. The property owner has never approached him to ask for access. There
is now a purchase offer on the land bordering the landlocked piece and the potential
buyer and/or buyers are adamant on having their privacy and there is restricted
convenience prohibiting any land owners having any right of ways that were not
included with the original subdivision reason being they did not want to
include a thru street. Mr. Rigby suggested if Mr. Luke would like to talk with
potential new owner and have a casual right away to do some logging he did not
for see that being an issue.
Member Ostrowski advised Mr.
Rigby that Planning Board is approving the Subdivision of lot 77.00-3-99 (Road)
into 2 parcels. The subdivided section of the road will merge with lots #77.00-3-9,
77.00-3-10, 77.00-3-11, 77.00-3-18 and 77.00-2-45.112. A hard line needs to
depict the road that is being subdivided labelled #2 and the remaining Road
labeled #1. In
addition, we would like to see the survey map include neighboring properties,
along with the property owner names and any existing structures on your
proposed subdivision lots, utilities (power lines, fire hydrants, and water
line, septic). Clerk Murray will send a
follow up letter to Mr. Rigby.
A form was download from Cayuga
County Real-Property and passed onto Mr. Rigby regarding merging the 5 lots.
7:25 Member Ostrowski motioned to close the Public
Hearing; Town Alternate Member Lipiska second the motion. VOTE: 4 ayes; 0 nays.
Carried.
7:30 Mr. Rigby left meeting.
RIZANT CORP.: PLAT MAP: 2-LOT SUBDIVISION: PROPERTY
LOCATED, 2292 STATE ROUTE 31; TAX MAP #77.00-2-22.3; 26.03 ACRES; RESIDENTIAL
& COMMERCIAL DISTRICT; FLOOD PLAIN (REPRESENTED by SALLY WALKER)
Ms. Sally Walker (Real Estate
Agent and Sub-Division representative) approached the board. Planning Board
members reviewed the maps submitted. Ms. Walker advised the board that there
was an error with the acreage that was previous reported as 33.69 acres and
should be 26.03 acres.
At the April 27th
, 2016 Planning Board meeting, Board members suggested the Rizzo’s to meet with
Code Enforcement Officer Tim Ganey to discuss the particulars on whether or not
to proceed with a third subdivision of the property. Ms. Walker stated that she
feels that did not occur and that the Rizzo’s would just like to proceed with a
2-lot sub-division.
Members advised that they
would like to see the mother lot labelled # 1 and the new lot(s) would be labeled # 2. In
addition, we would like to see the survey map include neighboring properties,

proposed subdivision lots, utilities (power lines, fire hydrants, and water
line, septic). Clerk Murray will send a follow up letter to Ms. Walker.
Member Ostrowski motioned to declare this a 2-lot
minor sub-division. Member Scanlon second the motion. VOTE: 4ayes; 0 nays.
Carried.
Member Ostrowski motioned to schedule a Public Hearing
for the June 22, 2016 Planning Board Meeting. Town Alternate Member Lipiska second
the motion.
VOTE: 4ayes; 0 nays. Carried.
7:40 Sally Walker left the meeting.
CURRY, DENISE: INFORMATIONAL: 2-LOT
SUBDIVISION: PROPERTY LOCATED 3594 CHAMBERLIN RD. WEEDSPORT, NY; TAX MAP #
84.00-2-32.2; 3.21 ACRES; AG/RESIDENTIAL DISTRICT
Brian Curry called the Town
Office (5/24/16) and spoke to Deputy Clerk Vicki Hickey regarding the 5/25/16
PB MEETING. He asked that the 2-LOT CURRY SUBDIVISION ON CHAMBERLIN RD
review be put on hold for 2-4 months and mentioned that the Curry’s will call a
couple of weeks before they are ready to pursue again.
CORRESPONDENCE/OTHER ITEMS:
- Brief discussions on Solar Farm Developers targeting local farms.
- Introduction of Tom Taylor, potential Town Alternate for Planning
Board.
