OPENING:
The meeting was called to
order at 7:00pm by Chairman Ostrowski who also led the Pledge of Allegiance.
Chairman Ostrowski asked if
there were any questions, additions or deletions to the minutes from the February
22, 2017 meeting. Member Gross motioned
to accept 2.22.17 minutes as written. Member Abraham second the motion. VOTE: 5
ayes; 0 nays. Carried.
- CORRADO,
ROD: CORRADO RIVERFOREST;FINAL PLAT;2-Lot
Subdivision; 9439 River Forest Rd; #76.00-1-26.11; 97.50 acres; AR; River
Front; Flood Zone
No one present to finalize the proposed
subdivision. Will table this to the April 26, 2017 Planning Board meeting.
Chairman Ostrowski spoke with Code Enforcement Officer Tim Ganey on the
proposed subdivision. There are mutual concerns about the Road and having an
easement.

CORRESPONDENCE/OTHER ITEMS:
- Discussion on Lot Line
Adjustment: Chairman
Ostrowski reached out to Amy D’Angelo a Senior Planner with Wayne County
Planning and questioned lot line adjustments. Currently there isn’t
anything specific in the code book and was wondering what the state
specific recommendations are on this. It was advised that “unless our
subdivision regulations define lot line adjustment as an action requiring
subdivision review this action would only be subjected to County Real Property
Tax and County Clerk for mapping and filing. If our law defines it as an
action subject to subdivision review then it would go through the same
process as a minor subdivision unless another process is specifically defined
for these actions. Every local law is different as to what action they
determine are subject to a subdivision.”
- Discussion on meeting recordings: Chairman Ostrowski also addressed Amy D’Angelo
the legalities regarding recording of a public hearing without any notice.
Was advised “any public meeting can be legally recorded either by the
board or by attendees. It is ideal for this to be disclosed but in NY only
one party has to know that the conversation is being recorded for it to be
a legal recording. The board cannot restrict or ban recordings or require
prior notice of a recording.”
CLOSING:
At 7:30 pm, Member Abraham motioned to adjourn the
meeting. Member Gross seconded the
motion. VOTE: 5 ayes; 0 nays. Carried.
