Planning Board Meeting Minutes

 (Regular Meeting)

 

Town of Brutus Municipal Building, 9021 North Seneca Street, Weedsport, NY 13166

Thursday November 16, 2017 at 7:00pm

 

Planning Board Members Present: John Abraham (V), Joe Barwinczok (T), Frank Gross (V),                           John Mlodzianoski (V-Alt), Derek Ostrowski (V&T), Nancy Sweet (V) Thomas Taylor (T-Alt), Dave Lipiska (T-Alt)

Absent:   Don Bowden (T), Jim Scanlon (T), Ed O’Neil (V-Alt), Lynette Murray— Planning Board Clerk

Also Present:

Meeting Attendants: Peter Kyle, Carolyn Kyle, Derric Slocum, Lisa Wattam and Shelly Wattam

 

OPENING:

The meeting was called to order at 7:00pm by Chairman Ostrowski who also led the Pledge of Allegiance.

Chairman Ostrowski asked if there were any questions, additions or deletions to the minutes from the October 25, 2017 meeting. Member Abraham noted the minutes should be corrected to indicate that he was absent instead of present.  Member Gross motioned to accept the 10.25.17 minutes with the correct to mark member Abraham absent. Member Abraham second the motion. VOTE: 5 ayes; 0 nays. Carried. 

 

  1. PETER and CAROLYN KYLE: INFORMATIONAL: 2-lot subdivision;8505  Ball Rd; Tax Map Id  #82.00-1-64; 86 acres; AR Dist.

Peter and Carolyn Kyle approached the board and explained that they wished to subdivide the property to separate the house and barn for transfer to their son Grant.  The board reviewed the provided map and determined that the property met all the necessary dimensions and setbacks.

Member Gross motioned to declare this a minor subdivision. Member Abraham second the motion. VOTE: 5 ayes; 0 nays. Carried.

The board members agreed the map looked good as is and Chairman Ostrowski indicated the Kyles could proceed with an application and pay the required fee. A public hearing would be scheduled for the next meeting on December 21st.

 

  1. PETER and CAROLYN KYLE (REPRESENTING VILLAGE HEIGHT HOMEOWNERS ASSOCIATION): INFORMATIONAL: 2-lot subdivision; Rosewood Circle; Tax Map Id #82.00-1-47.313(Town of Brutus)/# 82.12-2-35.11(Village of Weedsport); AR Dist.

Peter and Carolyn Kyle explained that they wished to subdivide the property that is partially a Village of Weedsport lot and partially a Town of Brutus lot at the corner of Hamilton and Cold Springs roads.  The new property line would extend from the rear of the Brown property to Cold Springs Rd.  Chairman Ostrowski asked if the property was one lot that was in both the Town and the Village and the Kyles indicated that it was.  The board agreed that the lot met the frontage requirements along Cold Springs Rd.  Member Gross questioned is this would need both Town and Village approval.  The board members indicated to the Kyles that the Planning Board acted in an advisory role to the Village of Weedsport and the Village Board would probably also need to approve the subdivision.  The Board concurred that the proposed subdivision met all the necessary sizes and setbacks.  The Kyles had indicated that the plan was to sell the lot to Derric Slocum (also present).  Chairman Ostrowski asked Mr. Slocum if he had talked to Code Enforcement Officer Ganey to ensure he would be able build any planned structures.  Mr. Slocum indicated that he done all the necessary checking to ensure he would be able to use the property as he intended as an agri-tourism business.

Member Abraham motioned to declare this a minor subdivision. Member Gross second the motion. VOTE: 5 ayes; 0 nays. Carried.

Chairman Ostrowski indicated there would be a public hearing at the December meeting and the Village Board would be contacted to determine how they wished to proceed with the Village Portion of the subdivision.

At approximately 7:20 pm Mr. Slocum and the Kyles left the meeting.

 

 

 

 

 

 

CORRESPONDENCE/OTHER ITEMS:

  • DISCUSSION PLANNING BOARD MEMBERS TERMS: Chairman Ostrowski discussed the confusion of member and alternate member terms with the Town Board and Village Board.  Both Boards agreed that there was no need to rotate members and alternate members.  Planning Board members will stay in that position and alternates will only be made regular members as necessary.
  • DISCUSSION on SOLAR FARMS (proposed ordinance): Chairman Ostrowski indicated that he had attended the Town Board meeting to provide a brief overview of the Solar Ordinance that the Planning Board had proposed to the Town.
  • DISCUSSION on updating the SUBDIVISION PROCESS in the Town Code Laws: Chairman Ostrowski indicated that he received approval from the Town Board to put together a working group of Planning Board members and Town Board members to review and revise the subdivision section of the Town Code.  This working group will be put together in early 2018

 

CLOSING:

8:00 pm, Member Gross motioned to adjourn the meeting.  Member Sweet seconded the motion.  VOTE: 5  ayes; 0 nays.  Carried.
