Planning Board Members Present Virtually on GoToMeeting: Frank Gross (V), Dave Lipiska (T), Derek Ostrowski (V&T), Nancy Sweet (V), Thomas Taylor (T), Joel Herrling (T-Alt)

Absent: Joe Barwinczok (T), Ken Carr (T-Alt), Ed O’Neil (V-Alt)

Also, Present Virtually on GoToMeeting: Lynette Murray (PB Clerk)

Virtual GoToMeeting Attendants:  James Hotaling (Town Supervisor), Steve Walczek (owner of Barber Welding)

OPENING:

The Planning Board held a virtual GoToMeeting on March 24, 2021. The invitation to the on-line meeting with link, phone number to call in, and access code was distributed on as follows:

           Emailed to the Planning Board members/group                         

           Posted on the Town Website

           Posted on both doors of Town Hall

The meeting was called to order at 7:00 pm by Chairman Ostrowski. Chairman Ostrowski asked if there were any questions, additions, or deletions to the minutes from the March 24, 2021 meeting.

Member Gross motioned to accept 03.24.2021 minutes as written. Member Sweet seconded the motion. VOTE: 5 ayes; 0 nays. Carried. 

 

  1. CHIRCO, NORMAN, ATTORNEY REPRESENTING NOLT, RAYMOND AND KATHRYN: INFORMATIONAL: 2-LOT SUBDIVISION:9306 OAKLAND ROAD:(#76.00-1-46.1):61 ACRES: AR.

No one present to discuss proposed sub-division. Chairman Ostrowski received a call from Mr. Chirco 15 minutes prior to the meeting. Mr. Chirco was not aware that he was on the Agenda for the 4.28.2021 PB Meeting. Chairman Ostrowski would like clarification and will be in touch with Mr. Chirco for clarification of the address on the application. Application received .has the project location at 9306 Oakland Rd Tax Map #76.00-1-46.1. No further decisions were made.

 

  1. POLLOCK, BRUCE (B&C STORAGE): FINALIZE: 2-LOT SUBDIVISION: SITE-PLAN REVIEW SELF-STORAGE: VACANT LAND STATE RT. 34:(#77.00-1-8.1.):62 ACRES: INDUSTRIAL DIST.

No one present. On April 16, 2021 Mr. Pollock emailed Clerk Murray and cc Chairman Ostrowski a copy of the notarized Representation form and on April 20, 2021 Mr. Pollock brought the hard copy of the form in the Town office for the file along with the paper copies of the maps for signing.

Clerk Murray and Chairman Ostrowski will arrange date and time to sign maps and notify Mr. Pollock when maps are ready, so he can pick up at the Town office.

 

  1. WALCZEK, STEPHEN (BARBER WELDING): INFORMATIONAL: (2)-2-LOT SUBDIVISION/RESUBDIVISION:2533 Erie Drive; TM # 82.12-1-3, 6.00 acres, within Village of Weedsport and Vac Erie Drive; TM # 82.12-1-4, 4.90 acres, within Village of Weedsport.

Steve Walczek and James Hotaling, Town Supervisor were present to discuss the sub-division/ re-subdivision.

The properties owned by Mr. Walczyk consist of three existing tax parcels. 

The two proposed future parcels, one 3.65 acres, which will be retained by Walczyk, and one 14.46-acre parcel which will be sold to the Town by Mr. Walczyk.

 

One thing the Town Engineer Piascik proposed on the maps was for Tax Map ID 82.12-01-05 should be indicated to be abandoned and combined it with Tax Map ID # 82.12-1-4.

Chairman Ostrowski further explained that this is new to our board and further researched New York State Code about abandoning subdivisions and found that there is a law on the books about, abandoning subdivisions and it’s been in place for at least five years. The law basically indicates a developer can decide “I'm not going to do anything with the subdivision, I want to abandon the parcels and it reverts back to its original partial. Chairman Ostrowski stated “as long as the county accepts it, I'm okay with it.”

 

 

Chairman Ostrowski would like to send a recommendation to the Village to proceed with the subdivision and to schedule a Public Hearing at the 5.12.2021 Village meeting.

Member Lipiska motioned to send recommendation to the Village to proceed with the subdivision and to schedule a Public Hearing at the 5.12.2021 Village meeting. Member Gross seconded the motion. VOTE: 5 ayes; 0 nays.  Carried.

 

            7:23 James Hotaling, Town Supervisor exited the meeting. 7:28 Steve Walczek exited the meeting.

CORRESPONDENCE/OTHER ITEMS:

o   UPDATE A-R (RIVER FRONT) SPECIAL PERMIT IN TOWN CODE:  

Pursuant to the March 24, 2021 PB meeting, Chairman Ostrowski emailed the letter regarding recommendations for Special Permits in A-R Agricultural Residential and R-F Riverfront Zoning, to the Planning Board members for review on April 26, 2021. Discussions on the letter were brought to the April 28, 2021 PB meeting. Everyone was in a consensus that the letter was precis and well formatted and agreed to forward to the Town Board as written.

Member Lipiska motioned to send the letter as written to the Town.  Member Gross seconded the motion. VOTE: 5 ayes; 0 nays.  Carried.

 

 

CLOSING:

7:45 pm, Member Lipiska motioned to adjourn the meeting.  Member Gross seconded the motion.

VOTE: 5 ayes; 0 nays.  Carried.
